These Terms and Conditions (“Terms”) govern your use of the You By Design website and any related services, products, or content (collectively, the "Platform"). By accessing or using the Platform, you agree to comply with these Terms. If you do not agree with these Terms, please do not use the Platform.

Acceptance of Terms

By registering, accessing, or using the Platform, you agree to comply with and be bound by these Terms.

If you do not agree, please discontinue using the Platform immediately.

Eligibility

By accessing or using the You By Design platform, you affirm that you meet the following criteria:

• You are at least 13 years old. If you are between the ages of 13 and 18 (or the age of majority in your jurisdiction), you confirm that you have obtained parental or guardian consent to use the platform.

• Users under the age of 13 are not permitted to access the platform, in compliance with applicable privacy regulations such as COPPA (Children’s Online Privacy Protection Act) and GDPR (General Data Protection Regulation).

• You have the legal capacity to agree to these Terms. If you are using the platform on behalf of a company or legal entity, you represent that you have the authority to bind that entity to these Terms.

By continuing to use the platform, you acknowledge and agree to these eligibility requirements.

Accurate Information

Accurate birth data (date, time, and location) is essential for the insights provided by the Platform.

Users must also provide accurate email and phone numbers for communication and access to features.

Use of the Platform

The Platform is designed to provide personalized insights using Human Design concepts and AI-powered tools. You agree to use the Platform in accordance with these Terms and applicable laws.

Specifically, you agree not to:

• Use it only for lawful purposes.

• Refrain from interfering with the operation of the Platform.

• Avoid uploading harmful content such as viruses or malware.

• Not reverse-engineer or extract the source code of any part of the Platform.

System Delays and Accuracy

While we strive to provide timely responses, delays in responses from the AI-powered system can occasionally occur due to technical reasons. We work diligently to minimize misinformation, but due to the nature of AI, some responses may not be fully accurate.

We encourage you to review the information provided critically, and for crucial decisions, seek professional advice.

Subscription and Payment

The Platform offers both free trials and paid subscriptions.

• Subscriptions are priced at $49 USD per month, with global access.

• Free Trials: Each user is eligible for one free trial, including access to two lessons, 10 AI Mentor questions, and ongoing access to the free community platform.

  Trials automatically end without conversion unless explicitly upgraded to paid status.

• Billing Cycle: Subscriptions are billed monthly from the initial payment date.

• Renewal: Payments renew automatically unless canceled.

• Payment Methods: Credit card only, processed via Stripe.

Trial Limitations

Trial subscriptions provide limited access to features, including the chatbot and classroom. Upon completion of the trial, continued access requires a paid subscription. Trial users are encouraged to provide feedback as part of their agreement to use the trial features.

Cancellation Policy

Users can cancel their subscription anytime through their user profile under "Subscriptions." Cancellation notifications will be sent via WhatsApp, specifying the last date of access.Access is revoked if payment fails after a 5-day grace period. Notifications will be sent, and access can be restored upon successful payment.

Refund Policy

Refunds are only issued in cases where technical issues persist and hinder your ability to use the Platform effectively. Refunds are not provided for incorrect user inputs, such as inaccurate birth data.To request a refund for ongoing technical issues, please contact support at: support@youbydesign.world

Content and Intellectual Property

All materials, including lessons, AI content, and other components, are owned by You By Design Pty Ltd.Content is for personal use only and cannot be shared, distributed, or reproduced without explicit permission.

Community Guidelines

To maintain a respectful and constructive environment, users agree to:

Refrain from offensive, discriminatory, or harmful behavior.Engage respectfully with other community members.Avoid sharing content that violates intellectual property rights or applicable laws.

Violation Consequences:

Accounts may be suspended or terminated for breaches of these guidelines.

Limitation of Liability

The Platform and its content are provided "as is" without any warranties, express or implied. You By Design disclaims all liability for damages, including direct, indirect, incidental, or consequential damages arising from the use of the Platform. This includes personal injury, loss of income, or other damages.

Global Use and Governing Law

These Terms are governed by the laws of Australia.

Any disputes arising from the use of the Platform will be resolved in accordance with Australian law.

User Responsibilities

You agree to use the Platform responsibly and not to share or distribute inappropriate or harmful content. You By Design reserves the right to remove any content that violates these Terms or is deemed inappropriate.

• Data Collection: Information such as names, email addresses, birth details, and chatbot interactions is collected solely for the operation of the Platform.

• Data Storage: Data is securely stored using platforms such as Go High Level, WhatsApp, and ChatGPT’s Enterprise system, following their respective privacy policies.

• Third-Party Services: Payment processing is handled by Stripe.

Data Retention and Security

User information, including birth data and chatbot interactions, will be stored securely and used solely for the purpose of providing services on the Platform. We follow best practices to ensure data protection. However, users are advised to exercise caution when sharing sensitive information.

The information and insights provided through the Platform are for informational and educational purposes only. They are not a substitute for professional advice, including but not limited to medical, psychological, legal, or financial advice.

Users are encouraged to seek appropriate professional guidance for their individual needs.

Changes to Terms
