1. Acceptance of Terms

By registering, purchasing, or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy. If you are using the Platform on behalf of a business or entity, you represent that you have authority to bind that entity to these Terms.

2. Eligibility

To use the Platform, you must:

Be 18 years or older.

Have the legal capacity to enter into a binding agreement.

You By Design does not knowingly permit individuals under 18 to access or use the Platform, in compliance with global privacy laws including COPPA and GDPR.

3. Accuracy of Information

Accurate birth details (date, time, and location) are essential for generating Human Design insights.
You also agree to provide accurate contact information (email and First Name/Last Name) for account access, communication, and service delivery.
Inaccurate details may affect your results or access to the Platform.

4. Use of the Platform

You agree to use the Platform solely for lawful, personal, and non-commercial purposes.
You agree not to:

Interfere with or disrupt the Platform’s operation.

Upload or distribute malware or malicious code.

Reverse-engineer, copy, or extract proprietary content or software.

Misuse may result in suspension or termination of your account.

5. AI and System Limitations

The Platform integrates AI-supported tools to provide educational and reflective Human Design insights. You acknowledge that:

AI responses may contain errors, omissions, or delays.

Information provided is educational, not professional or therapeutic advice.

You are responsible for interpreting insights appropriately and seeking professional guidance where needed (medical, financial, or psychological).

6. Monitoring and Safety

You By Design is committed to maintaining a safe and supportive digital space.
To protect users and uphold community integrity:

Conversations with the AI may be monitored in a privacy-compliant and limited way to ensure safety and quality.

If communication suggests self-harm, abuse, or significant distress, the system or moderators may offer supportive resources such as mental health helplines or emergency contact options.

You By Design is not a crisis service and cannot provide emergency intervention.
If you are in danger or distress, please contact local emergency services immediately.

7. Product Purchases and Subscriptions

The Platform offers:

Outright Purchase Products – One-time payments for digital courses, guides, or reports.

Subscription Products – Recurring monthly or annual access to AI-driven tools, community content, or educational programs.

All products are clearly labeled at checkout, including pricing, inclusions, and renewal details.

Payment and Renewal

Payments are securely processed via Stripe.

Subscription products automatically renew unless canceled prior to the next billing date.

Outright purchases do not renew and remain accessible as per the product description.

Cancellations

You can cancel a subscription anytime via your Customer Portal:

Settings → Billing & Subscription → Cancel under the relevant product.

Cancellations take effect at the end of the paid billing cycle.

Non-payment after a 5-day grace period may result in account suspension until payment is successful.

Refunds

Refunds are only available in cases of unresolved technical issues that prevent use of the Platform.
Refunds are not issued for user input errors (such as incorrect birth data) or change of preference.

8. Community Guidelines

You agree to:

Communicate respectfully and avoid offensive, discriminatory, or harmful behavior.

Not share private or copyrighted content without permission.

Engage constructively and uphold the purpose of the community.

Violation of these guidelines may result in account suspension or permanent removal.

9. Intellectual Property

All materials—including AI-generated content, course materials, videos, and lessons—are owned by You By Design Pty Ltd.
You may not copy, modify, share, or redistribute any part of the Platform’s content without explicit written permission.

Key points:

We collect minimal information (name, email, birth details, chat data) necessary for service delivery.

Data is securely stored through Go High Level and ChatGPT Enterprise, each governed by their own strict privacy standards.

Payment data is processed by Stripe; You By Design does not store credit card information.

User data is never sold or rented.

11. Data Retention and Security

User data and chat records are securely stored and retained only as long as necessary for operational or legal purposes.
While we follow industry-standard security practices, no online system is entirely immune from risk. You agree to share information responsibly and at your discretion.

All insights, responses, and materials provided through the Platform are for educational purposes only.
They are not intended as medical, psychological, legal, or financial advice.
You By Design makes no guarantees regarding personal outcomes or results.

13. Limitation of Liability

The Platform and all content are provided “as is.”
You By Design Pty Ltd is not liable for any direct, indirect, incidental, or consequential damages—including emotional distress, financial loss, or decision-making outcomes—arising from your use of the Platform.

14. Governing Law

These Terms are governed by the laws of Australia.
Any disputes will be resolved exclusively under Australian jurisdiction.

15. Changes to Terms

We may update these Terms periodically to reflect operational or legal updates.
Revised Terms take effect upon posting to the Platform. Continued use signifies acceptance of the updated Terms.
